On July 10, 2024, the Materials Decree was amended regarding asbestos certificates for common parts and commonly used parts (Art. 3 §2). As of January 1, 2027, an asbestos certificate for common parts in co-ownership will be mandatory. This obligation applies generally, regardless of sales transactions.
The term "Commonly Used Parts" (CUP) refers to a single owner who manages a building where multiple tenants are present. These tenants may access common areas. The term "Common Parts" (CP) refers to a property in co-ownership, where co-owners can also access common parts such as the hall, corridor, elevator, etc. The obligation to obtain a certificate for CUP is mandatory from May 1, 2025, while for CP it is required from December 31, 2026 - be prepared in time!
